Terms and Conditions of Sale
The online store available on the Bancarel website has been established by Bancarel SAS, which operates and fully owns this website. Any full or partial reproduction of the site or its content is strictly subject to prior authorization from Bancarel.
Any order placed for a product featured in the online store on the bancarel.com website implies prior consultation and acceptance of these General Terms and Conditions of Sale. Consequently, the customer acknowledges being fully informed that their agreement to the content of these General Terms and Conditions does not require a handwritten signature, insofar as the customer wishes to order the products presented online through the website store.
The customer may save or print these General Terms and Conditions, provided that saving or printing this document remains solely their responsibility.
Prior to placing an order, the customer declares that the purchase of the products is not directly related to their professional activity and is intended strictly for personal use. As a consumer, the customer therefore benefits from specific rights, which may be invalidated if the products or services purchased through the website are in fact related to their professional activity.
The online store operated by Bancarel on its website provides the following information:
- Legal notice enabling the precise identification of Bancarel
- Presentation of the essential characteristics of the products offered
- Prices of products displayed in Euros, including delivery costs where applicable
- Information regarding payment, delivery, and execution terms
- The existence of a right of withdrawal, except for made-to-order products
- The validity period of the offer or price
- All of this information is presented in the French language.
The customer declares that they have full legal capacity to commit to these General Terms and Conditions.
ARTICLE 1: ENTIRE AGREEMENT
These General Terms and Conditions express the full extent of the obligations of the parties. In this respect, the customer is deemed to accept without reservation all of the provisions set out in these General Terms and Conditions.
No general or specific conditions appearing in documents sent or provided by the customer may be incorporated into these Terms and Conditions if such documents are incompatible with the present General Terms and Conditions.
ARTICLE 2: PURPOSE
These General Terms and Conditions are intended to define the rights and obligations of the parties in the context of the online sale of goods and services offered by Bancarel to the customer.
ARTICLE 3: CONTRACTUAL DOCUMENTS
The present contract is formed by the following contractual documents, presented in descending order of priority:

ARTICLE 4: EFFECTIVE DATE – DURATION
These General Terms and Conditions come into effect on the date the purchase order is signed. They remain valid for the duration necessary for the supply of the subscribed goods and services, until the expiration of the guarantees provided by Bancarel.
ARTICLE 5: ELECTRONIC SIGNATURE
The customer’s “double-click” validation of the purchase order constitutes an electronic signature which has, between the parties, the same legal value as a handwritten signature.
ARTICLE 6: ORDER CONFIRMATION
The contractual information will be confirmed by email no later than the time of delivery or, failing this, sent to the address provided by the customer in the purchase order.
ARTICLE 7: PROOF OF TRANSACTION
Computerized records stored in Bancarel’s computer systems under reasonable security conditions shall be considered as proof of communications, orders, and payments exchanged between the parties.
Purchase orders and invoices are archived on a reliable and durable medium that may be produced as evidence.
ARTICLE 8: PRODUCT INFORMATION
8-a: Bancarel presents on its website the products offered for sale with the necessary characteristics required to comply with Article L111-1 of the French Consumer Code, which allows potential customers to know, before placing a final order, the essential characteristics of the products they wish to purchase.
8-b: The offers presented by Bancarel are valid only while stocks last.
8-c: Photos are non-contractual. Colors may appear lighter or darker depending on the screen settings or the lighting conditions when the photos were taken. Shades are provided for indicative purposes only.
Bancarel offers its customers the possibility to request free samples before placing an order. Requests can be made through the contact section.
ARTICLE 9: PRICES
Prices are indicated in Euros and are valid only on the date the purchase order is submitted by the customer. Delivery charges are not included and will be charged in addition to the product price; they are indicated before the order is confirmed.
Prices include the VAT applicable on the date of the order. Any change in the applicable VAT rate will automatically be reflected in the prices of the products offered in the online store.
Full payment of the total price must be made at the time of ordering.
ARTICLE 10: PAYMENT TERMS
To pay for their order, the customer may choose from all payment methods listed on the purchase order.
The customer guarantees to Bancarel that they have the necessary authorizations to use the payment method selected when validating the purchase order.
Bancarel reserves the right to suspend any order processing and any delivery in the event of refusal of payment authorization by officially accredited banking institutions or in the event of non-payment.
Bancarel also reserves the right to refuse delivery or to honor an order from a customer who has not fully or partially paid for a previous order or with whom a payment dispute is currently being processed.
Bancarel has implemented an order verification procedure to ensure that no person uses another individual’s banking details without their knowledge. As part of this verification process, the customer may be asked to send proof of address by fax to Bancarel.
The order will only be validated after receipt and verification of the requested documents by our services.
ARTICLE 11: PRODUCT AVAILABILITY
Orders will be fulfilled within a maximum period of:
35 days from the day following order confirmation for made-to-order items (custom-made seat covers and floor mats for cars and motorhomes).
5 days for items manufactured in small series (universal seat covers and mats, Premier range, accessories, etc.).
In the event that an ordered product becomes unavailable, particularly due to suppliers (fabrics, threads, etc.), the customer will be informed as soon as possible and will have the option to cancel the order.
The customer may then choose either:
A refund of the amounts paid within 30 days at the latest from the payment date, or
An exchange for another product.
ARTICLE 12: DELIVERY TERMS
Products are delivered to the address provided by the customer on the purchase order.
Orders for custom-made seat covers and floor mats will be shipped within a maximum period of 35 days from the validation of the order (“double-click” confirmation).
The customer is required to check the condition of the packaging upon delivery and report any damage caused during transport to the carrier on the delivery slip, as well as to Bancarel, within one week.
Upon request, the customer may receive the invoice at the billing address instead of the delivery address by selecting the appropriate option on the purchase order.
For shipping, we work with Colissimo Suivi and TNT for bulky parcels. As soon as an order is dispatched, the customer will immediately receive an email notification including the tracking number.
LA POSTE
To minimize shipping costs, all small and medium-sized products are shipped using the Colissimo Suivi postal service. In addition to being cost-effective, this service delivers within 48 hours throughout France and allows customers to collect their order from the post office closest to the delivery address if they are absent at the time of delivery.
In practice, if the customer is absent on the delivery day, the postal carrier will leave a delivery notice in the mailbox, allowing the parcel to be collected from the local post office during opening hours within 15 days.
Colissimo Suivi is a highly reliable service. However, as with any shipment, delivery delays or parcel loss may occasionally occur.
If there is a delivery delay compared to the date indicated in the shipping confirmation email, the customer is asked to notify us by phone or email. We will then contact La Poste to initiate an investigation.
A postal investigation may take up to 21 days from the date it begins. If the product is found during this period, it will be immediately redirected to the customer’s address.
However, the customer may request cancellation of the order starting from the 7th day after the scheduled delivery date.
Bancarel will refund all sums paid within 30 days.
If the product is not found after the 21-day investigation period, La Poste will consider the parcel lost. Only at that point can we send a replacement product at our expense.
If the ordered product(s) are no longer available at that time, we will refund the amount corresponding to the products affected by the carrier’s loss.
SHIPPING RATES AND DELIVERY TIMES
We undertake to ship your parcel within 72 hours for pre-manufactured items such as accessories, universal seat covers, and Premium seat covers (except in the event of stock shortages).
For our custom-made products, shipping times depend on several factors such as the number of elements to be covered, seat design, fabric material, etc. On average, orders are shipped within 15 to 20 days.
In all cases, we undertake to ship your parcel within 35 working days following the validation date of your order (except in cases of fabric shortages, holiday periods, etc.). The order validation date corresponds to the date the production process begins.
Your order is considered validated once our technical team has received all the necessary information regarding your vehicle. You will receive an email informing you that your order status has changed to “In Production”. From that moment, your order can no longer be cancelled.
For your convenience, we offer several delivery methods:
- TNT for delivery within 24 hours after shipping (excluding manufacturing time, only for metropolitan France, not valid for Corsica), with home delivery or in a Relais Parcel: Package 15 €.
- For Corsica: we can not ship via TNT. For technical reasons we can not exclude Corsica into the proposed transport choices. It is mentioned for TNT: excluding Corsica. The customer still choosing to be delivered to Corsica and having chosen transportation via TNT, will receive his package via the post office.

ARTICLE 13: CARRIER DELIVERY ISSUES
Any anomaly relating to the delivery (missing product compared to the delivery note, damaged parcel, etc.) must be indicated on the delivery note in the form of "handwritten reservations", accompanied by the customer's signature.
The consumer must also confirm such anomaly by sending the carrier a registered letter with acknowledgment of receipt within ten (10) business days following the delivery date, setting out the relevant claims.

ARTICLE 14: DELIVERY ERRORS
14-a: The consumer must submit to Bancarel any claim relating to a delivery error and/or the non-conformity of products in terms of type or quality compared with the information stated on the order form, on the day of delivery or, at the latest, on the first business day following delivery. Any claim made after this period shall be rejected.
14-b: Such claims may be submitted to Bancarel:
preferably by telephone at +33 (0)5 65 67 22 11;
by logging onto our website and accessing the “Track Your Order” section, where, after entering your customer number, you may submit your question through the “Contact Us” menu, clearly specifying the order reference; or
by email to info@bancarel.com.
14-c: Any claim not made in accordance with the procedures and within the time limits set out above shall not be taken into account and shall release Bancarel from any liability towards the consumer.
14-d: Upon receipt of the claim, Bancarel shall assign an exchange authorization number for the product(s) concerned and communicate it to the consumer by email, fax, or telephone. No product exchange may take place until such exchange authorization number has been issued to the consumer in accordance with the procedure described above.
14-e: In the event of a delivery error or product exchange, any product to be exchanged or refunded must be returned to Bancarel in its entirety and in its original packaging, by registered Colissimo mail, to the following address:

To be accepted, any return must first be reported to Bancarel Customer Service. Return shipping costs shall be borne by Bancarel, except where it is established that the returned product does not correspond to the original declaration made by the consumer in the return form.
ARTICLE 15: PRODUCT WARRANTY
The provisions of these Terms and Conditions shall not deprive the consumer of either the statutory warranty against hidden defects or the legal guarantee of conformity. The following provisions are recalled:
Article L217-4 of the French Consumer Code:
The seller shall deliver goods that conform to the contract and shall be liable for any lack of conformity existing at the time of delivery.
The seller shall also be liable for any lack of conformity resulting from the packaging, assembly instructions, or installation where such installation is the seller’s responsibility under the contract or has been carried out under the seller’s responsibility.
Article L217-5 of the French Consumer Code:
Goods shall be deemed to conform to the contract:
1° If they are fit for the purposes for which goods of the same type are normally used and, where applicable:
if they correspond to the description given by the seller and possess the qualities presented to the buyer in the form of a sample or model;
if they possess the qualities that a buyer may reasonably expect in light of the public statements made by the seller, the producer, or their representative, particularly in advertising or labeling;
2° Or if they possess the characteristics mutually agreed upon by the parties or are suitable for any specific purpose sought by the buyer, made known to the seller and accepted by the latter.
Article L217-12 of the French Consumer Code:
Any action arising from a lack of conformity shall be time-barred after two (2) years from the date of delivery of the goods.
Article 1641 of the French Civil Code:
The seller is bound by the warranty against hidden defects in the goods sold which render them unfit for their intended use, or which impair such use to such an extent that the buyer would not have purchased them, or would have paid a lower price for them, had the buyer been aware of such defects.
Article 1648, Paragraph 1 of the French Civil Code:
Any action arising from latent defects must be brought by the purchaser within two (2) years from the date on which the defect was discovered.
ARTICLE 16: RIGHT OF WITHDRAWAL
The right of withdrawal does not apply to custom-made seat covers and floor mats, as these are products manufactured to order and personalized according to the customer’s specifications.
The right of withdrawal applies only to products from the Standard and Premier ranges.
The consumer has a period of fifteen (15) working days to return, at their own expense, any products that do not meet their expectations. This period begins on the day the order is delivered to the consumer. If this period expires on a Saturday, Sunday, public holiday, or non-working day, it shall be extended until the next working day.
Any return must first be notified to Bancarel Customer Service:

by logging into our website and accessing the “Track Your Order” section, where, after entering your customer number, you will be able to obtain your order number.

Only products returned complete and in their original packaging will be accepted. Any product that has been damaged will neither be refunded nor exchanged.
The right of withdrawal may be exercised without penalty, except for the cost of returning the goods.
Where the consumer exercises the right of withdrawal, they may choose either:
to receive a refund of the amounts paid; or
to exchange the product.
In the event of an exchange, the cost of reshipping the replacement product shall be borne by the consumer.
Where the right of withdrawal is exercised, Bancarel shall make every effort to reimburse the consumer within fifteen (15) days. However, given the technical nature of the products sold, this period may be extended to thirty (30) days, particularly where the returned product requires technical inspection (e.g., products that must be tested before acceptance of the return).
The consumer shall be reimbursed by crediting their bank account (secure transaction) in the case of payment by credit card, or by cheque in all other cases.

ARTICLE 17: FORCE MAJEURE
Neither party shall be deemed to have failed in the performance of its contractual obligations to the extent that such performance is delayed, hindered, or prevented by an unforeseeable event (cas fortuit) or an event of force majeure.
A fortuitous event or force majeure shall mean any irresistible circumstance or event beyond the control of the parties, which is unforeseeable, unavoidable, independent of the parties’ will, and which cannot be prevented by them despite all reasonable efforts.
The party affected by such circumstances shall notify the other party within ten (10) working days of becoming aware of the event.
The parties shall then consult with one another within one (1) month, unless prevented from doing so by the force majeure event, in order to assess the impact of the event and agree on the conditions under which performance of the contract shall continue.
It is expressly agreed that, in addition to events traditionally recognized as force majeure by the jurisprudence and courts of France, the following shall also be considered cases of force majeure or fortuitous events:
disruption or blockage of transportation or supply channels; earthquakes; fires; storms; floods; lightning strikes; interruptions of telecommunications networks; and difficulties affecting telecommunications networks external to the parties or their customers.
Such events shall relieve the affected party from liability for the duration of the force majeure event and to the extent that performance of its obligations is prevented thereby.
ARTICLE 18: PARTIAL INVALIDITY
Should one or more provisions of these General Terms and Conditions be held invalid or declared invalid pursuant to any law, regulation, or final decision of a competent court, the remaining provisions shall remain in full force and effect.
ARTICLE 19: NO WAIVER
The failure of either party to invoke a breach by the other party of any obligation set out in these General Terms and Conditions shall not be construed as a waiver of the right to rely upon such obligation in the future.
ARTICLE 20: GOVERNING LAW AND DISPUTES
These General Terms and Conditions shall be governed by and construed in accordance with French law. This applies both to substantive and procedural rules.
In the event of any dispute or claim, the consumer shall first contact Bancarel by email at sav@bancarel.com in order to seek an amicable resolution. The consumer may also use the European Online Dispute Resolution (ODR) platform:

The consumer may refer any consumer dispute to MEDICYS after first attempting to resolve the matter directly with Bancarel.
ARTICLE 21: DATA PROTECTION AND PRIVACY
The information requested from the consumer is necessary for the processing of their order and may be communicated to Bancarel’s contractual partners involved in the performance of that order.
The consumer may contact Bancarel, whose contact details are provided in the Privacy Policy available on the website, in order to object to such communication or to exercise their rights of access and rectification regarding personal data concerning them held in Bancarel’s files, in accordance with the provisions of the French Data Protection Act of 6 January 1978.
Furthermore, we collect the customer's telephone data and inform them of the BLOCTEL scheme, the French telephone marketing opt-out register:

BLOCTEL is the official telephone solicitation opt-out list on which any consumer may register free of charge in order to avoid receiving unsolicited marketing calls from professionals with whom they do not have an ongoing contractual relationship, in accordance with French Law No. 2014-344 of 17 March 2014 relating to consumer protection.
